1. Acceptance of Terms

By creating an account, browsing listings, submitting an inquiry, listing apparatus for sale, or otherwise using the Site, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy. These Terms apply to all visitors, registered users, buyers, and sellers.

You represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are accessing the Site on behalf of a fire department, municipality, dealer, or other organization, you represent that you have the authority to bind that organization to these Terms.

2. Account Registration & Responsibilities

Certain features of the Site require registration. You agree to provide accurate, current, and complete information when creating your account and to keep that information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to notify us immediately of any unauthorized use of your account or any other security breach. Fenton Fire is not liable for any loss or damage arising from your failure to protect your account credentials.

Providing false or misleading information, including identity or contact details, may result in immediate suspension or removal from the platform and forfeiture of any pending transactions.

3. Listing Apparatus & Seller Obligations

Sellers may list fire apparatus and equipment for sale on the Site. You are solely responsible for the accuracy of your listings, including specifications, condition, year, make, model, photos, and price. You represent that you have clear title or lawful authority to sell any apparatus you list and that the apparatus is free of liens or encumbrances unless clearly disclosed.

Fenton Fire is a marketplace facilitator and does not take ownership of listed apparatus. We do not independently verify every detail provided by sellers, though we may review, edit, reject, or remove any listing at our discretion. Sellers remain responsible for the safekeeping, inspection, and delivery of their apparatus until a sale is finalized.

Sellers agree to respond to legitimate inquiries in a timely manner and to negotiate in good faith. Once a sale is pending or complete, sellers must keep their listing status current on the Site.

4. Inquiries, Leads & Lead Handling

Buyers may submit inquiries, request location details, quotes, shipping estimates, financing calculations, or printed listing information. Fenton Fire vets and routes these leads to sellers based on each seller's chosen lead-handling preference. Fenton Fire may, at its discretion, contact buyers on behalf of sellers or facilitate introductions between parties.

Buyers authorize Fenton Fire to share their contact information with the relevant seller when a lead is connected, and to use submitted information to facilitate the transaction. Sellers agree to use buyer contact information solely for the purpose of the related inquiry and transaction and not for unrelated marketing or resale.

Fenton Fire does not guarantee that any inquiry will result in a sale, nor that buyers or sellers will complete a transaction. We are not a party to any agreement between a buyer and a seller.

5. Broker Commissions & Sales

Fenton Fire may earn a commission or brokerage fee on completed sales that originate through the Site. The applicable commission rate, if any, is agreed separately with the seller and is separate from the purchase price negotiated between buyer and seller.

Sellers agree to disclose any commission obligation to buyers where required by law and to honor agreed sale terms. Fenton Fire may assist with documentation, such as bills of sale, but the legal responsibility for the transfer of title and any applicable taxes, fees, or registrations remains with the buyer and seller.

"For sale by owner" or off-platform sales to parties introduced via the Site may still be subject to Fenton Fire's brokerage commission as agreed at listing time.

6. Prohibited Conduct

You agree not to:

• Post false, misleading, fraudulent, or infringing listings or content;
• Use the Site to sell stolen, illegal, unsafe, or misrepresented apparatus or equipment;
• Harvest, scrape, or collect contact information from the Site for mass unsolicited outreach;
• Interfere with or disrupt the Site, its servers, or its security features;
• Impersonate another person or organization, or misrepresent your affiliation;
• Attempt to bypass any fees, commissions, or lead-handling processes established by Fenton Fire;
• Use automated scripts or bots to access the Site in a way that exceeds reasonable personal use.

Violations may result in removal of listings, account suspension, forfeiture of pending leads, and where appropriate, referral to law enforcement.

7. Intellectual Property

The Site, its design, branding, text, and software are owned by Fenton Fire and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute Site content for commercial purposes without our written permission.

By uploading listing content, photos, or specifications to the Site, you grant Fenton Fire a non-exclusive, royalty-free license to host, display, reproduce, and edit that content solely for the purpose of operating and promoting the marketplace. You represent that you own or have rights to all content you submit.

8. Disclaimers & Limitation of Liability

The Site is provided on an "as is" and "as available" basis. Fenton Fire makes no warranties regarding the accuracy, completeness, or reliability of any listing, specification, or statement made by buyers or sellers. Apparatus is sold "as is" unless otherwise agreed in writing between buyer and seller.

To the fullest extent permitted by law, Fenton Fire and its officers, employees, and affiliates shall not be liable for any indirect, incidental, consequential, or special damages, including lost profits, arising from your use of the Site or from any transaction or interaction between buyers and sellers. Our total aggregate liability for any claim related to the Site is limited to the amount of any commission or fee we received in connection with the listing or transaction giving rise to the claim.

Buyers are strongly encouraged to inspect apparatus, request service records, and verify specifications before completing a purchase. Fenton Fire recommends independent third-party inspection services.

9. Indemnification

You agree to indemnify and hold harmless Fenton Fire and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site, your listings, your dealings with other users, or your violation of these Terms. Fenton Fire reserves the right, at its own expense, to assume the exclusive defense of any matter for which you are required to indemnify us.

10. Govering Law

These Terms are governed by the laws of the jurisdiction in which Fenton Fire Equipment Ltd. is incorporated, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in that jurisdiction for any dispute arising out of or relating to these Terms or the Site.

11. Changes to Terms

Fenton Fire may update these Terms from time to time. We will post the updated Terms on this page with a revised "Last updated" date. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the Site.
